This crime took place in Darmstadt, Germany, while Martinelli was stationed there. In April 2000 Martinelli entered a guilty plea for charges of sending, receiving, reproducing and possessing child pornography.

Beginning in January 1999 through January 2000 Martinelli downloaded images of child pornography from the Internet using computers located at the off-post Netzwork Internet Café in Darmstadt, Germany. He would search internet websites and log into internet chat rooms in order to communicate with individuals willing to send him images.

He would ultimately secure the images through email addresses he had through Yahoo and Hotmail or he would be directed to websites that had the images, where he would download them directly.

The computer at the Netzwork Internet Cafe that he used and logged into, had 64 images of child pornography on it. Once he received the images, he would copy them and redistribute the images. He send approximately 20 such child pornography images via his Yahoo and Hotmail email addresses.

He also copied those images to disks which he then took to barracks at the Cambrai Fritsch Kaserne base. There he would copy the images onto more disk, or keep them on his computer.

He was charged with violations:

§ 2252A(a)(1), 
Mailing, shipping, transporting child pornography (receiving images from the internet)

§ 2252A(a)(2)(A), 
Mailing, shipping, transporting child pornography (downloading images from the internet)

§ 2252A(a)(3)
Downloading child pornography from the internet

§ 2252A(a)(5)(A)
Possessing approximately 50 diskettes of child pornography

He was sentenced by a military judge to a dishonorable discharge, confinement for three years, forfeiture of all pay and allowances and reduced rank to E-1.

On November 24, 2003 the charges and conviction were reviewed, and upheld.
