Case: United States v. Martinez
Date Of Conviction: August 28, 1992
Plea: Guilty
Charges: Forcible Sodomy, Indecent Assault
Military Branch: U.S. Army
Listed In National Sex Offenders Registry? NO

The defendant, Sgt. 1st Class David J. Martinez of Albuquerque, N.M., who is on active duty, was charged with one count of forcible sodomy, one count of indecent assault and four counts of making false statements concerning the accusations by the woman, Specialist Jacqueline Ortiz of Sapello, N.M., a reservist with whom he was assigned last year in Saudi Arabia.

Specialist Ortiz, 28 years old, was among a group of women who testified this summer before a United States Senate committee about sexual attacks against them. Ms. Ortiz said at that hearing that she had immediately reported the attack but that officers had ignored her complaint.

The Army at first concluded that the sexual contact between her and Sergeant Martinez was consensual. But it reopened the case earlier this year at the urging of a Congressman from her home state, Bill Richardson.

Martinez, 43, pleaded guilty to a sodomy charge and to making false statements. He was given a bad-conduct discharge. A more serious charge of indecent assault and one other count of making false statements were dropped.
