Leura Garrett Canary, United States Attorney for the Middle District of Alabama, announced today that Mark Adam Fotis, age 37, of Yorktown, VA, was sentenced to 46 months in federal prison; 3 years supervised release; and a special assessment fine of $100, for possession of child pornography, a violation of Title 18, USC 2252A(a)(5)(A). Mark Adam Fotis was named in a two-count Indictment by a Middle District of Alabama Grand Jury on February 9, 2005.

At the time of this Indictment, Fotis was a Technical Sergeant, having served in the United States Air Force since early 1987. On June 6, 2005, Fotis pled guilty to Count 2 of the Indictment, charging him with knowingly possessing child pornography on his United States Air Force Laptop computer at Gunter Air Force Base.

The evidence at the sentencing hearing showed Fotis used his United States Air Force Micron Laptop to access an internet website containing child pornography and to house images of children engaged in sexually explicitly conduct.

Upon hearing of the September 7, 2005 sentencing, Ms. Canary stated, “Each and every time an individual visits an internet website containing images of children engaged in sexually explicit activity, that is, a child pornography website, a child is further victimized. The United States Attorney’s Office will continue standing up for children by prosecuting child pornography offenders.”

The prosecution of this case, from arrest through sentencing, relied on the hard work and diligence of a number of state and federal law enforcement agencies, including the U.S. Postal Service, USAF Office of Special Investigations, and the Bureau of Immigration & Customs Enforcement.
