Private 1st Class Roger Cruz, a Soldier assigned to the 69th Transportation Company, 28th Transportation Battalion in Germany, was convicted by an enlisted panel at a General Court Martial February 19, 2010 of one specification of violating Article 86, Uniform Code of Military Justice, AWOL; two specifications of violating Article 89, disrespect to superior commissioned officer; two specifications of violating Article 90, willfully disobeying a superior commissioned officer; one specification of violating Article 107, false official statement; one specification of violating Article 120, aggravated sexual assault; one specification of violating Article 125, forcible sodomy; and two specifications of violating Article 134, adultery and breaking restriction.

Cruz was sentenced to be reduced to the grade of E-1, to forfeit all pay and allowances, to be confi ned for 10 years and to be discharged from the Army with a dishonorable discharge
